Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs the use of all cloud VPS hosting services and related products (the “Services”) provided by Hostcloud360, a brand of MEXA TECHUB USA LLC, a limited liability company registered in the State of Florida, United States (“we,” “us,” or “our”). This AUP is incorporated into and forms part of our Terms of Service.

The purpose of this AUP is to protect our customers, our network, and the wider internet from abuse. You are responsible for all use of your VPS instances, including use by your own users, clients, or any third party you permit to access them. A violation by anyone using your instance is treated as a violation by you.

1. Illegal Activity

You may not use the Services to engage in, promote, facilitate, or store any content or activity that is illegal under applicable law, including but not limited to:

  • Child sexual abuse material (CSAM) of any kind — zero tolerance; immediate termination and mandatory reporting to authorities;
  • Fraud, identity theft, financial scams, Ponzi or pyramid schemes, or deceptive commercial practices;
  • Sale or distribution of illegal drugs, weapons, or other contraband;
  • Human trafficking or exploitation;
  • Terrorism, incitement to violence, or threats against any person or group;
  • Gambling services operated without required licenses;
  • Violation of export control or sanctions laws.

2. Email Abuse and Spam

You may not:

  • Send unsolicited bulk email (spam), whether commercial or otherwise, from or through the Services, or use the Services to support spam sent from elsewhere (e.g., hosting landing pages, mailboxes, or DNS for spam campaigns);
  • Send email that violates the CAN-SPAM Act or equivalent laws, including mail with forged headers, misleading subject lines, or no functioning unsubscribe mechanism;
  • Operate an open mail relay or open proxy;
  • Harvest email addresses or send mail to purchased/rented lists without verifiable opt-in consent.

We may restrict outbound mail ports (e.g., SMTP port 25) by default and require justification to unblock them.

3. Security Violations and Network Abuse

You may not:

  • Access or attempt to access any system, network, or data without authorization;
  • Conduct port scans, vulnerability scans, or penetration tests against systems you do not own or have written authorization to test;
  • Originate, participate in, or control denial-of-service (DoS/DDoS) attacks, botnets, or command-and-control infrastructure;
  • Distribute, host, or develop malware, ransomware, viruses, rootkits, or exploit kits;
  • Host phishing pages, credential-harvesting forms, or fake login pages impersonating any brand or service;
  • Forge network headers, spoof IP addresses, or intercept traffic not intended for you;
  • Use the Services to anonymize or relay attacks or abuse (including running open resolvers or amplification-prone services in an insecure configuration).

4. Resource Abuse and Fair Use

The Services run on shared physical infrastructure. You may not:

  • Use resources in a way that materially degrades performance for other customers, including sustained maximum CPU usage beyond fair-use levels;
  • Run cryptocurrency mining of any kind (CPU or GPU) unless expressly permitted in writing for your plan;
  • Operate public/open proxies, public VPN exit nodes, or Tor exit nodes without prior written approval;
  • Deliberately circumvent bandwidth, storage, or resource limits of your plan, or manipulate Pay-As-You-Go usage metering;
  • Use a VPS purely as a storage/backup dump or file-distribution mirror in violation of plan intent, where the plan is sold as a compute service.

We may throttle, isolate, or suspend instances that create operational risk to the platform, with notice where practicable.

5. Intellectual Property Infringement

You may not host, store, distribute, or link to content that infringes copyrights, trademarks, patents, or trade secrets, including pirated software, cracked licenses, warez, key generators, or unauthorized streaming/distribution of copyrighted media.

We respond to copyright complaints in accordance with the Digital Millennium Copyright Act (DMCA), as described on our DMCA & Abuse Reporting page. Infringement notices should be sent to abuse@hostcloud360.com and must include the information required by 17 U.S.C. § 512(c)(3). We may remove or disable access to allegedly infringing material and may terminate repeat infringers’ accounts.

6. Harmful, Abusive, or Deceptive Content

You may not use the Services to host or distribute:

  • Content that harasses, defames, stalks, or threatens others, or that incites hatred or violence against individuals or groups;
  • Non-consensual intimate imagery;
  • Content that deliberately misrepresents its origin or impersonates any person or entity, including brand impersonation and typosquatting sites operated in bad faith;
  • Sites or services whose primary purpose is to facilitate any activity prohibited elsewhere in this AUP.

7. Reselling

You may resell services built on your VPS (e.g., hosting your clients’ websites) provided that you remain fully responsible for your end users’ compliance with this AUP and you pass through equivalent acceptable-use obligations to them. You may not resell in a way that misrepresents who operates the underlying infrastructure or that violates our Terms of Service.

8. Monitoring and Investigation

We do not routinely monitor the content of customer instances. However, we may investigate suspected violations of this AUP — including reviewing network telemetry, logs, and, where necessary and lawful, instance content — in response to abuse reports, security alerts, legal process, or anomalous activity. We cooperate with law enforcement where required by law.

9. Enforcement

Depending on the severity of a violation, we may take one or more of the following actions, with or without prior notice:

  1. Warning and a deadline to remedy the violation;
  2. Throttling or isolation of the affected instance;
  3. Suspension of the instance or account pending investigation;
  4. Termination of the Services without refund, as provided in the Terms of Service and Refund & Cancellation Policy;
  5. Reporting to law enforcement or relevant authorities where legally required or appropriate.

For severe violations (e.g., CSAM, active attacks, phishing, malware distribution), we will suspend or terminate immediately and without notice.

We reserve the right to recover from you any costs, penalties, or damages we incur as a result of your violation (including IP-reputation remediation and third-party claims), as set out in the indemnification provisions of the Terms of Service.

10. Reporting Abuse

To report abuse involving any Hostcloud360-hosted service (spam, phishing, attacks, illegal content, copyright infringement), email abuse@hostcloud360.com with:

  • The IP address or domain involved;
  • A description of the abusive activity;
  • Relevant evidence (log excerpts, full email headers, URLs, timestamps with time zone).

11. Changes to This Policy

We may update this AUP from time to time to address new forms of abuse or changes in law. Updates take effect when posted on this page with a revised “Last Updated” date. Material changes will be notified as described in the Terms of Service. Continued use of the Services after the effective date constitutes acceptance.
