DMCA & Abuse Reporting

Hostcloud360, a brand of MEXA TECHUB USA LLC, a limited liability company registered in the State of Florida, United States, provides cloud VPS infrastructure on which customers host their own content. We take reports of copyright infringement and abuse seriously. This page explains how to submit a report and what happens after you do.

Important: Hostcloud360 is an infrastructure provider. Content on customer servers is uploaded and controlled by our customers, not by us. In most cases, the fastest resolution is achieved by contacting the website owner directly; where that fails, use the procedures below.


1. Copyright Infringement (DMCA Notices)

We comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. If you believe that material hosted on our network infringes your copyright, send a written notification to our Designated Agent containing all of the following (as required by 17 U.S.C. § 512(c)(3)):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  2. Identification of the copyrighted work claimed to be infringed (or a representative list if multiple works);
  3. Identification of the allegedly infringing material and information reasonably sufficient to locate it (exact URLs and, where relevant, the IP address of the server);
  4. Your contact information: name, mailing address, telephone number, and email address;
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Incomplete notices may not be actionable. Knowingly misrepresenting that material is infringing may expose you to liability under 17 U.S.C. § 512(f).

What happens next

Upon receiving a valid notice, we will promptly forward it to the affected customer and, where appropriate, remove or disable access to the identified material or require the customer to do so within a stated deadline. Customers who repeatedly infringe will have their accounts terminated in accordance with our repeat-infringer policy (Section 3).

2. DMCA Counter-Notification

If you are a Hostcloud360 customer and believe material you posted was removed or disabled by mistake or misidentification, you may submit a written counter-notification to the Designated Agent above containing:

  1. Your physical or electronic signature;
  2. Identification of the material that was removed and its location before removal;
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, the United States District Court for the Middle District of Florida), and that you will accept service of process from the person who filed the original notice or their agent.

If we receive a valid counter-notification, we will forward it to the original complainant. Unless the complainant notifies us within ten (10) business days that they have filed a court action seeking to restrain the alleged infringement, we may restore the removed material within 10–14 business days of receiving the counter-notification.

3. Repeat-Infringer Policy

In accordance with the DMCA, we maintain a policy of terminating, in appropriate circumstances, the accounts of customers who are repeat infringers. We track valid infringement notices per account, and accounts accumulating multiple substantiated notices are subject to suspension or termination under our Terms of Service and Acceptable Use Policy.

4. Trademark and Other Intellectual Property Complaints

For trademark infringement or other non-copyright IP complaints, email abuse@hostcloud360.com with: identification of your mark (including registration number and jurisdiction, if registered), the allegedly infringing URLs, an explanation of the claimed infringement, and your contact details. We review such complaints case by case and may forward them to the customer for response.

5. Reporting Other Abuse

To report abuse originating from or hosted on our network — including phishing, malware, spam, network attacks, fraud, or illegal content — email abuse@hostcloud360.com with:

  • The IP address, domain, or URL involved;
  • The type of abuse and a description of what you observed;
  • Supporting evidence: complete email headers (for spam), log excerpts with timestamps and time zone (for attacks), or screenshots/URLs (for phishing and fraud);
  • Your contact details for follow-up.

For urgent, ongoing incidents (active attacks, live phishing pages), mark the subject line URGENT — these are prioritized.

For reports involving child sexual abuse material (CSAM), we act immediately: content is preserved as required for law enforcement, the account is terminated, and the matter is reported to the National Center for Missing & Exploited Children (NCMEC) and/or relevant authorities, in accordance with our zero-tolerance policy and applicable law.

6. How We Handle Abuse Reports

  1. Acknowledgement — we aim to acknowledge abuse reports within 48 hours;
  2. Investigation — we verify the report against network telemetry, logs, and the reported material;
  3. Action — depending on severity, we may notify the customer with a remediation deadline, disable specific content, isolate or suspend the instance, or terminate the account without notice for severe violations, as set out in our Acceptable Use Policy;
  4. Follow-up — where you provide contact details, we will inform you of the outcome to the extent we can while respecting customer privacy and legal constraints.

We do not disclose customer information to complainants except as required by law or valid legal process.

7. Law Enforcement Requests

Law enforcement agencies seeking customer information or preservation should contact abuse@hostcloud360.com. We require valid legal process (e.g., subpoena, court order, or warrant, as applicable) before disclosing non-public customer information, except in emergencies involving imminent danger of death or serious physical injury where the law permits disclosure.
